Terms of Service

1. Acceptance of Terms

You agree to these terms by downloading and using the Griz app.

By downloading, installing, or using Griz (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. Poppies Studios ("we," "us," or "our") may update these terms at any time. Your continued use following an update means you accept the changes.

2. Eligibility

Griz is for adults only — you must be 18 or older to use it.

You must be at least 18 years old to use Griz. By using this Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into this agreement. If you are under 18, you may not use Griz.

3. What Griz Does

Griz is an AI-powered dating coach that helps you draft text replies and conversation starters.

Griz is a premium iOS app that:

• Reads chat screenshots or message context you provide
• Sends that content to our backend and to Anthropic (Claude) for analysis
• Returns three AI-generated reply suggestions in a tone you select
• Operates as a keyboard extension, iMessage extension, and standalone app
• Caps free users at 3 generations per day; paid subscribers receive unlimited generations

Important: Griz suggestions are drafts, not professional advice. The AI may make errors, suggest inappropriate content, or misunderstand context. You are solely responsible for reviewing, editing, and deciding whether to send any message before it reaches another person.

3A. Keyboard Extension & Message Context Transmission

How Griz uses text context when you tap Generate in the keyboard.

When using the Griz keyboard extension, tapping "Generate" will transmit up to 500 characters of surrounding text (before and after your cursor) to Anthropic's Claude AI model. This text may include:

• Your own messages and drafts
• Messages from the other person in the conversation
• Other contextual information visible in the conversation thread

This content is transmitted over HTTPS, processed by Claude, and not retained by Griz or Anthropic for training. You are responsible for ensuring you have the legal right to share this data with us. If the context includes another person's private messages, you represent and warrant that you have their consent to submit this content for AI processing. California law (Penal Code §631) prohibits unauthorized disclosure of private communications, and you alone bear responsibility for compliance.

4. Account & Authentication

Griz does not require an account. We use a device ID instead.

Griz does not ask for your name, email, phone number, or password. Instead, a unique device identifier (UUID) is auto-generated on first use and stored in the app group shared by Griz's three targets (main app, keyboard extension, iMessage extension). This UUID is used to track your daily generation quota and billing status. You can view your device ID in the Griz app under Settings.

5. Subscriptions & Billing

All subscriptions are processed by Apple through In-App Purchase.

Griz Pro offers the following subscription plans through Apple's In-App Purchase system:

• Griz Pro Yearly: $59.99 per year, includes a 3-day free trial for new subscribers
• Griz Pro Monthly: $9.99 per month (no free trial)
• Griz Pro Yearly (Special): $19.99 per year, includes a 3-day free trial — offered at our discretion as a one-time promotional rate

All pricing is in USD. Subscriptions are billed to your Apple ID account and renewed automatically at the end of each billing period unless canceled. Billing is handled entirely by Apple; Poppies Studios does not store or process your payment information. You can manage or cancel subscriptions at any time through Settings > Apple ID > Subscriptions.

5A. Auto-Renewing Subscription Terms (ROSCA Compliance)

Important disclosures about your subscription before you purchase.

Free Trial & Auto-Renewal:

• If you start with a yearly plan that includes a free trial, your trial begins immediately and lasts 3 days
• At the end of Day 3, your free trial automatically converts to the paid subscription you selected
• You will be charged $59.99 per year (or $19.99 per year if you accepted the special discount offer) starting Day 4, then annually on the same date
• The monthly plan ($9.99/month) does not include a free trial; you are charged immediately and every month thereafter
• You can cancel anytime in Settings > Apple ID > Subscriptions
• There are NO refunds for partial billing periods, except as required by Apple
• Cancellation must occur at least 24 hours before your next billing date to avoid charges

6. Free Trial

Some plans include a free trial before charging begins.

Free trial length varies by plan and is displayed on the paywall before purchase. Your subscription will automatically renew at the end of the trial unless canceled in iOS Settings before the trial ends. Cancellation must occur at least 24 hours before renewal to avoid being charged.

7. Refunds & Cancellation

Apple controls refunds; we cannot issue refunds on our end.

Refunds for Griz subscriptions are handled by Apple per their standard policy. If you wish to request a refund, visit reportaproblem.apple.com. You can cancel your subscription at any time from iOS Settings, and you will retain access through the end of your current billing period. Poppies Studios cannot cancel subscriptions or issue refunds directly.

8. License Grant

We grant you a limited, non-exclusive license to use Griz on your device.

Subject to these terms, we grant you a limited, non-exclusive, non-transferable license to use Griz on Apple-branded devices that you own or control. This license does not permit you to: copy, modify, or create derivative works; reverse-engineer, decompile, or disassemble; remove copyright notices; use unlawfully; scrape or crawl; abuse infrastructure; resell; or use competitively.

9. User Content & Submissions

You own your screenshots and messages. You grant us the right to process them for the Service.

You retain all rights to screenshots, messages, or text you submit. By submitting, you warrant you own the content and have consent from anyone else pictured. We process your content solely to provide Griz and do not retain it after processing. Anthropic does not train on API content by default.

10. AI Disclaimer

AI suggestions are not professional advice. The model can make mistakes.

Griz uses Anthropic's Claude model. AI models can produce inaccurate, misleading, or inappropriate output; misunderstand context; or hallucinate facts. You are solely responsible for reviewing every suggestion before sending it. Griz is a coaching tool only and is not a substitute for professional relationship advice, therapy, or counseling.

10A. AI-Generated Content & Dating Platform Disclosure (CA AB 1001 & NY S.4625)

Your responsibility when using Griz suggestions on dating apps.

Griz provides AI-generated suggestions for dating messages. You alone are responsible for how you use these suggestions. You represent and warrant that:

• You will review each suggestion for accuracy and appropriateness before sending
• If you send a suggestion to another person on a dating platform, that person has the right to know the message was drafted with AI assistance
• You will not fraudulently represent an AI-generated message as your own original thought if the recipient objects to AI-assisted conversation
• You will comply with the terms of service of any dating platform you use (Hinge, Bumble, Tinder, etc.) regarding use of AI tools

California Residents (AB 1001): If you use Griz suggestions in messages on dating platforms, you acknowledge that California law requires you to be transparent about AI use if the recipient requests disclosure.

New York Residents (S.4625): If you use Griz in conjunction with any dating service licensed to operate in New York, you acknowledge that New York law requires disclosure of AI use. You will not use Griz to generate content for a dating profile or match message on a NY platform without clearly indicating to the recipient that the content was drafted with AI assistance.

Griz is a coaching tool, not a dating app. Griz makes no representations about the legal or ethical implications of using AI-generated content in your dating conversations, and you alone are liable for the consequences of your use.

11. Termination

We can terminate your access if you violate these terms.

We may suspend or terminate your access at any time if you violate these terms or abuse the Service. Upon termination, your right to use Griz ceases immediately.

12. Disclaimers

Griz is provided as-is without warranties.

GRIZ IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT GRIZ WILL BE UNINTERRUPTED OR ERROR-FREE.

13. Limitation of Liability

Our liability is capped.

IN NO EVENT SHALL POPPIES STUDIOS BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) AMOUNT PAID IN LAST 12 MONTHS, OR (B) $50.

14. Indemnification

You agree to defend us if your use causes harm.

You agree to indemnify Poppies Studios from claims, damages, or expenses arising from your use, content, violation of these terms, or infringement of third-party rights.

15. Governing Law

These terms are governed by California law. Disputes are resolved in Santa Clara County courts.

These Terms of Service are governed by California law without regard to conflict-of-law principles. Any legal action shall be brought exclusively in Santa Clara County, California courts.

Note to lawyer: Confirm this governing law and venue before production.

16. Severability

If any part is invalid, the rest stands.

If any provision is found invalid, that provision shall be severed, and remaining provisions shall remain in full force.

17. Entire Agreement

This is the complete agreement regarding Griz.

These Terms of Service, together with our Privacy Policy, constitute the entire agreement and supersede all prior or contemporaneous agreements.

18. Apple's Role

Apple is a third-party beneficiary of these terms.

You acknowledge that Apple is a third-party beneficiary and has the right to enforce these terms. We are responsible for warranty and product claims. Apple has no obligation to support Griz.

19. Changes to Terms

We may update these terms at any time.

We reserve the right to modify these terms. If we make material changes, we will update the "Last updated" date. Continued use means you accept the changes.
